Mixed-development project: EIA prescribed activity classification and permit strategy

CHALLENGE

A Kuala Lumpur developer was uncertain whether their 25-acre mixed-use development in Selangor triggered a Detailed or Preliminary EIA, and whether certain components required separate prescribed activity assessments. Two consultants had given conflicting assessments.

APPROACH

We conducted a legal mapping of the project against the EIA Order 2015 Schedule, reviewed the draft consultant reports for regulatory alignment, and produced a written opinion on the applicable process pathway. We then coordinated with the consultant team on terms of reference preparation before JAS submission.

OUTCOME

Detailed EIA classification confirmed. Submission accepted by JAS without query on the classification question. Approval received within the expected statutory period. The client avoided a resubmission cycle that had affected a comparable project in an adjacent site.

Board-level sustainability governance documentation for Main Market issuer

CHALLENGE

A Main Market-listed manufacturing group had a sustainability statement that described commitments without supporting governance documentation. A Bursa review query had flagged the absence of a formal board-level sustainability policy and supporting framework.

APPROACH

We conducted a gap analysis against the Bursa Sustainability Reporting Guide, facilitated a materiality assessment with senior management, and drafted a suite of board-level policies covering climate, human rights, responsible sourcing, and anti-modern-slavery obligations.

OUTCOME

Policies adopted by the board within the reporting cycle. The company's subsequent sustainability statement was prepared against a documented governance framework. The Bursa query was resolved. The policies were described by the board as practical and actionable, not just nominal commitments.

JAS compound response and prosecution avoidance for effluent discharge incident

CHALLENGE

An industrial facility in Johor had experienced an effluent discharge exceedance following equipment failure. JAS had issued a notice and was considering formal prosecution under the Environmental Quality Act 1974. The facility had a generally clean compliance record prior to the incident.

APPROACH

We developed a factual matrix with the facility's environmental consultant, documented the equipment failure sequence, and prepared a comprehensive written response to JAS demonstrating the exceptional circumstances, the remediation steps taken, and the compliance programme enhancements implemented.

OUTCOME

JAS accepted the written response. The matter was resolved by administrative compound rather than prosecution. Facility operations continued throughout the process. The remediation programme we helped structure formed part of the regulatory record supporting the settlement.
